2022 Climate Positive Leaders Program Official Rules

1. ELIGIBILITY

The 2022 Climate Positive Leaders Program ("Program") is open to farmers and/or ranchers who are 21 or older, nominated or invited by nonprofit organizations, grower groups, universities, or technical assistance providers (“Nominators”), whose primary occupation is farming or ranching, and have implemented regenerative or climate positive practices on at least ten percent of his/her farm or land (“Applicants”) in the following countries: United States of America, Canada, Brazil, Argentina, France, United Kingdom, Ireland, Spain, India, New Zealand, Australia and Kenya. Because the GFN Roundtable & Leadership Training is conducted only in English, Applicants must be fluent in English to be eligible to be recognized as a Climate Positive Global Leader. Because the virtual GFN Farmer Communication Training Master Class is offered only in English, Spanish, French, and Portuguese, Applicants must be fluent in English, Spanish, French, and/or Portuguese to be eligible to be recognized as a Climate Positive Regional Leader. Void outside of the United States of America, Canada, Brazil, Argentina, France, United Kingdom, Ireland,  Spain, India, New Zealand, Australia, and Kenya, and where prohibited.  The following persons are not eligible to enter the Program: (a) persons who on or after August 30, 2022, were or are a director, officer, sales representative, or employee of Sponsor, its parents, subsidiaries and affiliates, and their respective agents, advertising and promotion agencies; (b) individuals engaged in the development, production, or distribution of materials for this Program; (c) persons who are not eligible to lawfully participate in the Program, and/or (d) employees of government agencies associated with the regulation of products used in the farming and ranching practices that are the subject of this Program, and their immediate families.

2. PROGRAM PERIOD

Program begins on August 30, 2022, at 12:01 a.m. Central Time (“CT”) and ends on January 30, 2023, at 11:59 p.m. CT.

3. HOW TO ENTER

There are two ways to enter. To enter during the entry period (August 30, 2022- January 30, 2023), Applicants will either enter online by completing and submitting the application form (“Application”) via a web address provided directly to the Applicant by a Nominator, or by completing the application form available via the web address provided and then submitting it via email to climatepositiveleaders@corteva.com.  Limit one entry per Applicant.

4. PROGRAM TIMELINE/ ENTRY EVALUATION

A.    Between August 30, 2022 and January 30, 2023, Applicants will complete and submit the online application form via the link provided by a Nominator or submitted via email to the climatepositiveleaders@corteva.com, and provide information related to their potential eligibility for the program, aligned with a scorecard used for final selections. Applicants who have submitted their application prior to November 30, 2022, are allowed to edit and resubmit their application until January 30, 2023.

B.    Information provided by the applicants will be collated by Corteva and a third-party vendor, The Context Network, with executed confidentiality agreements in place, for judging Applications.

C.    Between January 30, 2023 and March 10, 2023, a panel of judges comprised of individuals knowledgeable about climate positive practices from Corteva and other organizations, which may include but are not limited to, nonprofit organizations, grower groups, universities, and technical assistance providers, will evaluate applications in accordance with the criteria set forth in the Application, then apply a score to each Application. During this period, Applicants may be contacted to provide additional supportive documentation and/or answer follow-up questions related to their Application. Nominators may also be contacted for verification purposes.

D.    In the event of a tie, the Application with the highest score in the following category shall be the winning entry: “How have you shared or scaled practices to other farmers in your surrounding community or beyond?”.

E.    In each region (USA; Canada; Latin America (Brazil, Argentina); Europe (France, United Kingdom, Ireland, Spain), Asia Pacific (India, New Zealand, Australia), Kenya), the top scoring Global Leaders and Regional Leaders will be identified. The number of selected Applicants from each country/region will be as follows:

i.   USA: three (3) Global Leaders; two (2) Regional Leaders;

ii.   Canada: one (1) Global Leader; two (2) Regional Leaders;

iii.   Latin America (Brazil and Argentina): two (2) Global Leaders; two (2) Regional Leaders;

iv.   Europe (France, United Kingdom, Ireland, and Spain): one (1) Global Leader; two (2) Regional Leaders;

v.   Kenya: one (1) Global Leader; two (2) Regional Leaders;

vi.   Asia Pacific (Australia, India, New Zealand): two (2) Global Leaders; two (2) Regional Leaders.

F.   In May 2023, selected winners and runners-up will be notified via email and/or phone call of their selection.

G.  Between May 15, 2023 and May 31, 2023, selected winners will be announced and the winners’ Applications and contact information will be forwarded to Global Farmer Network to initiate the program benefits.

5. BENEFITS/ VALUES/ ODDS

A.       Each of the ten selected Global Leaders in each country/region will receive the following benefits:

  • Membership in the Global Farmer Network
  • Access to other early adopters and agriculture leaders through engagement with Global Farmer Network and its broad platform
  • Leadership and communications training to support farmers as they share their experience, including:
    1. Participation in an upcoming Global Farmer Network Roundtable & Leadership Training program
    2. Support in development of a personal virtual farm tour to communicate their climate positive journey
  • Engagement with business, research, agronomy, and agriculture leaders along with the opportunity to share their practices and experience across Corteva's global platform.
  • Invitation to a virtual event to meet fellow Climate Positive Leaders, and their nominators, and learn from speakers about climate positive practices.

B.       Each of the twelve selected Regional Leaders will receive the following benefits:

Participation in one of a virtual Global Farmer Network Farmer Communication Training Master Classes. 

Following completion of the Global Farmer Network Farmer Communication Training Master Class, Corteva Climate Positive Regional Leaders will be recognized as Global Farmer Network Fellows.

Engagement with business, research, agronomy, and agriculture leaders along with the opportunity to share their practices and experience across Corteva's global platform.

Invitation to a virtual event to meet fellow Climate Positive Leaders, and their nominators, and learn from speakers about climate positive practices.

C.    Approximate Retail Value (“ARV”) of all retail benefits to each Global Leader: $13,250 - $15,500 (USD).  ARV of retail benefits to each Regional Leader: $7,500 (USD). Total ARV of all retail benefits $222,000 - $245,000.

D.    Benefits shall be awarded as donations from Sponsor to the winners. Applicants should consult their personal tax advisor, accountant or attorney to discuss the potential tax liabilities incurred as a result of receiving the program benefits contained herein.

E.    There is no random element to this Program and the odds of winning depend on the skill and demonstrated agricultural practices of the entrants.

F.    All awards set forth in this clause 5 are subject to any applicable tax assessed in the jurisdiction in which the award is paid.

6. GENERAL CONDITIONS

Participants agree that the Sponsor and its subsidiaries, and affiliates, and each of their respective officers, directors, employees and agents, (individually and collectively "Releasees") are released, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind (whether due to negligence or otherwise) to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Program, and, (b) that Releasees have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, and THE RELEASEES HEREBY DISCLAIM ANY AND ALL SUCH WARRANTIES INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. By accepting a benefit, each Global Leader and Regional Leader grants permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, in perpetuity, for advertising, trade, publicity and promotional purposes without additional compensation (except where legally prohibited), in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval. Entrants may be required to complete, sign and return an Affidavit of Eligibility, a Liability Release, and where lawful a Publicity Release within seven (7) days of date on notification. If documents are not returned in a timely manner, or if the benefit notification or benefit is returned as non-deliverable, or if a potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, benefits will be forfeited and an alternate winner will be selected in accordance with these Rules.

7. LIABILITY LIMITATIONS

Releasees are not responsible for lost, late, misdirected, incomplete, illegible, or non-delivered entries, or technical errors or difficulties, or printing errors, clerical, typographical or other error in the offering or announcement of any benefit or in any benefit notification documents, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of registration, entry or other information or the failure to capture, or loss of, any such or similar information. Should any portion of the Program be, in Sponsor's sole opinion, compromised by non-authorized human intervention, technical failures or any other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Program, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Decisions of the judging panel and Sponsor made in connection with this Program are final and binding and no correspondence will be entered into with respect thereto.

8. PRIVACY POLICY

Information submitted with an entry is subject to the Privacy Policy stated on the corteva.com website. All applicants to the program have to provide the consent when registering to the program and providing their information.

9. REQUIREMENTS/ PROHIBITIONS/ DISQUALIFICATION

A. Entries must be submitted online by completing and submitting the application form via the web address provided directly to the Applicant by a Nominator, or by completing the application form available via the web address provided and then submitting it via email to climatepositiveleaders@corteva.com before 11:59 pm CT on January 30, 2023.

B. Applicants must be individuals whose primary occupation is farming and/or ranching, who are 21 or older, and nominated with a nomination letter from a nonprofit organization, grower group, university, or technical assistance providers.

C. Sponsor may, in its sole discretion, disqualify submissions that do not comply with the foregoing requirements.

10. FORCE MAJEURE

Subject to any governmental approval which may be required, Sponsor reserves the right, without prior notice and at any time, to terminate the Program, in whole or in part, or modify or suspend the Program in any way, if it determines, in its sole discretion, that the Program is impaired or that fraud has destroyed or severely undermined the proper entry, integrity, and/or feasibility of the Program. In the event Sponsor is prevented from continuing with the Program as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic or health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, provincial or local government law, order, or regulation, public health crisis (e.g. SARS, COVID-19), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Program. If the Program is terminated, in whole or in part, before the designated end date, Sponsor will select winners (or the remaining winners, as the case may be) from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Only the type and quantity of prizes described in these Official Rules will be awarded.

11. INVALIDITY

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of Sponsor.

12. GOVERNING LAW/ ARBITRATION

This Program is offered only in Argentina, Australia, Brazil, Canada, France, United Kingdom, Ireland, Kenya, Spain, India, New Zealand, and the United States, and is governed by the laws of the state of Iowa, United States. All claims relating in any manner to this Program or to any entry must be resolved in the federal or state courts located in Polk County, Iowa. To the extent permitted by law, the parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Program. To the extent permitted by law, any controversy or claim arising out of or relating to these Official Rules and/or the Program shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Polk County, Iowa. Laws in a participant’s country of residence may give the participant the right to file claims before the courts of that country and may provide that some laws of that country are also applicable to this Program. However, if any provision of the these Official Rules or the application of any such provision to any person or circumstance shall be declared to be invalid, unenforceable or void, such decision shall not have the effect of invalidating or voiding the remainder of these Official Rules, it being the intent and agreement of the parties that these Official Rules shall be deemed amended by modifying such provision to the extent necessary to render it valid, legal and enforceable while preserving its intent or, if such modification is not possible, by substituting therefore another provision that is valid, legal and enforceable so as to materially effectuate Sponsor’s intent.

To receive a copy of the Official Rules, mail a self-addressed stamped envelope to 2022 Climate Positive Leaders Program Official Rules Request, Corteva Agriscience LLC, 9330 Zionsville Road, Indianapolis, IN 46268. All requests must be received by the end of the Program Period. Limit one request per stamped outer envelope. VT residents may omit return postage.

14. Global Leaders and Regional Leaders LIST

Global Leaders and Regional Leaders will be posted online at https://www.corteva.com/sustainability/climatepositive/leaders-program.html. For a copy of the Official Global Leaders and Regional Leaders List, mail a self-addressed stamped envelope to: Climate Positive Winners List Request, Corteva Agriscience LLC, 9330 Zionsville Road, Indianapolis, IN 46268. All requests must be received by December 31, 2023. Limit one request per stamped outer envelope. VT residents may omit return postage.
